NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID IN CA, TN AND WHEREVER ELSE PROHIBITED. SWEEPSTAKES BEGINS 12:00:01 A.M. CT ON SEPTEMBER 15, 2008 AND ENDS AT 11:59:59 P.M. CT ON DECEMBER 31, 2008 ("SWEEPSTAKES PERIOD").
1. Who May Enter the Sweepstakes. Sweepstakes is only open to legal residents of the 50 United States and the District of Columbia (except residents of CA and TN) who are 21 years of age and older. The following persons are NOT eligible to participate: Employees, directors and officers of Freixenet USA, PO Box 1949, Sonoma, CA 95476, USA ("Sponsor"), the advertising and promotional agencies of Sponsor (collectively the foregoing shall be referred to as "Sweepstakes Parties"), and licensed alcohol beverage wholesalers, retailers, and their respective employees, families, and household members. Subject to all federal, state, and local laws and regulations. Void in CA, TN and wherever else prohibited by law.
2. How to Enter the Sweepstakes. During the Sweepstakes Period, go online and complete and submit in full an official entry form at the website www.tapenawines.com. Follow on-screen directions to properly complete an entry form. You will then be asked a series of questions about wine, the region in which Tapeña wine is produced (Tierra De Castilla, Spain) and related subjects about Madrid and the food, wines and Spanish culture associated with that region. Participants that complete all required information on the entry form, answer all of the questions correctly as determined by the Sponsor in Sponsor's sole discretion, and click the "I accept" button on the web site will be entered into the Sweepstakes. Correct answers to all questions are required for entry. Information to help answer the questions may be found easily throughout the quiz itself or at www.tapenawines.com. Limit one entry per person, household, and/or e-mail address per month. Any form of entry other than that described herein is void. Sweepstakes Parties assume no responsibility for lost, late, misdirected, stolen, mutilated, illegible, undelivered, garbled, damaged, incomplete entries or submissions, or for any computer, online, telephone or technical malfunctions that may occur. Sweepstakes Parties also assume no responsibility for any technical problems in connection with transmission or receipt of online entries including faulty electronic data transmission, traffic congestion on the Internet or on the web site, hardware or software error, equipment failure or malfunction, or other online communications problems. All entrants must have a valid email address. In the event of a dispute regarding the identity of the person submitting an entry, entries will be declared made by the Authorized Account Holder of the e-mail address submitted at the time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access provider, online service provider, or other organization (e.g., business, educational institution, etc.) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. In the event of a dispute over the ownership of an e-mail address, the Authorized Account Holder of the designated e-mail address will be considered the potential winner of any prize. Multiple participants are not permitted to share the same email address. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified. All entries become the property of Sponsor and will not be returned to entrant. Automated entries (including but not limited to entries made using any script, macro, bot, or sweepstakes service) and facsimiles are not allowed. Potential winner may be requested to provide Sponsor with proof that the potential winner is the Authorized Account Holder of the e-mail address associated with the winning entry.
3. Winner Selection. The winner will be selected in a random drawing to take place on or about January 15, 2009 an independent judging organization ("Judge"), whose decisions are final and binding on all matters related to the Sweepstakes. Odds of winning depend on the number of eligible entries received. The winner will be notified by mail. If any prize correspondence (including e-mail) is returned as non-deliverable, prize may be forfeited. Winner will be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release within fourteen (14) days of attempted notification or prize may be forfeited.
4. Sweepstakes Prizes. ONE (1) GRAND PRIZE: A trip for four (4) to Madrid, Spain. Grand Prize includes roundtrip coach air transportation for the winner and up to three (3) guests from the commercial airport with major airline jet service nearest winner's home to Madrid Spain; five (5) nights hotel accommodations (two (2) rooms, double occupancy) at a hotel designated by Sponsor; and $4,000 in American Express Travelers Cheques for winner. No substitution, cash redemption or transfer of prize is permitted except at Sponsor's sole discretion. If prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Any portion of the prize not accepted by winner shall be forfeited. The approximate retail value (ARV) of the Grand Prize is $14,000, but actual retail value may vary depending on airfare price fluctuations and the actual point of departure. Any difference between stated approximate value and actual value of prize will not be awarded. All other expenses not specifically mentioned herein, including additional ground transportation, meals, gratuities, travel documents, tax(es), personal expenses and all other expenses not specified herein are the sole responsibility of the winner. Trip must be taken before July 15, 2009 or prize will be forfeited. No responsibility is assumed by Sponsor for cancelled, delayed, suspended or rescheduled events after ticketing of prize for any reason whatsoever beyond their control. Transportation and accommodations are subject to availability. Blackout periods, government restrictions and regulations, hotel, airline, airport and other restrictions and regulations may apply. Winner and guests must have all necessary identification and/or travel documents (e.g. a valid U.S. passport, as applicable) required for travel. Winner and guests must travel on the same itinerary. Winner's guests must also be 21 years or older, and will be required to sign a travel/publicity release prior to ticketing of prize. All taxes and any expenses not expressly mentioned above as being paid by the Sponsor are solely the responsibility of the winners.
5. Release. By receipt of any Sweepstakes prize, winner and winner's guests agree to release and hold harmless Sweepstakes Parties (including, but not limited to Wencel/Hess) and all of their respective officers, directors, shareholders, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use of any prize, including any travel related thereto. By accepting prize, winners consent to let Sponsor use his/her name and likeness in all media now known or hereinafter developed without territorial or time limitation without further payment, except where prohibited by law.
6. General Conditions. By participating, entrants agree to these Official Rules, Sponsor's Privacy Policy (available at www.gloriaferrer.com) and to the Judge's decisions, which are final and binding in all respects. Sweepstakes Parties reserve the right to cancel, suspend and/or modify the Sweepstakes if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
7. Limitations of Liability. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) unauthorized human intervention in any part of the entry process or the Sweepstakes; (3) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (4) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use of any prize, including any travel related thereto.
8. Disputes. This Sweepstakes shall be governed by the laws of California, without respect to conflict of law doctrines. By entering, participating or accepting any prize in this Sweepstakes, you agree that California courts shall have exclusive jurisdiction over any dispute or litigation arising from or relating to this Sweepstakes and that venue shall be only in Sonoma County, California. Further, in any such dispute, under no circumstance will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, including reasonable attorneys' fees, other than participants actual out-of-pocket expenses (i.e. costs associated with this Sweepstakes).
9. Winners List. For the names of the Sweepstakes winners, send a hand-printed, self-addressed, stamped envelope to: Wencel/Hess, 400 S. Green Street, Loft H, Chicago, IL 60607. Requests must be received by February 15, 2009.
